As we celebrate the New Year, we take a backward glance at 2009

Welcome to the first newsletter of 2010.
As is traditional and expected at this time
of year we are taking a backward glance at legal developments during 2009, now known as the last decade!

In employment terms our newsletter year can best be summarised in three words, holidays, holidays and more holidays. We had the long awaited decision in the case of Stringer, concerning the accrual of holidays during long term sick leave, where the outcome can best be described as good in parts. The issue of maternity leave spanning different holiday periods, whilst explored, remains unresolved. However, the right to reinstated holiday entitlement when sick during planned annual leave, was introduced in some circumstances although its full effect has yet to be experienced.

Looking forward, the Equality Bill is the major legislation due
to be implemented. Presently before the House of Lords, it is by no means certain to become law in advance of a general election. Thereafter we will have to wait and see if a new government, of any colour, increases or decreased the amount of legislation we all have to consider.
